By accessing our website, submitting a rental or service request, or entering into any booking with us, you agree to these Terms & Conditions.
1. Definitions

Client / Renter / Customer: The individual or organization renting equipment or hiring services from the Company.

Equipment: Any audio, video, lighting, staging, or other gear owned or sub-rented by the Company.

Services: Any audio engineering, mixing, consulting, delivery, setup, teardown, or related services.

2. Website Usage
2.1 Acceptance of Use
By using our website, you agree not to misuse, damage, overload, or attempt unauthorized access to any part of the site or associated systems.
2.2 Accuracy of Information
We aim to keep our website information accurate and current; however, pricing, availability, and service descriptions may change without notice. We are not responsible for typographical errors or outdated content.
2.3 Account Security
If the website offers account creation, you are responsible for maintaining the confidentiality of your login information.

3. Rental Policies
3.1 General Rental Requirements
To rent equipment, you must:
Be at least 18 years old
Provide accurate contact information
Present a valid ID upon delivery or pickup (if requested)
Agree to all rental terms prior to receiving the equipment
3.2 Rental Period
The rental period begins at the agreed-upon delivery or pickup time and ends when the equipment is returned or retrieved by the Company.
3.3 Delivery & Pickup
Delivery and pickup may be free within the Omaha area (or as specified).
For locations outside our free zone, additional travel fees apply.
Clients must be present at the scheduled time; delays may incur fees.
3.4 Equipment Condition & Responsibility
Upon delivery or pickup, you accept the equipment in good working condition. From that moment until it is returned, you are fully responsible for:
Loss
Theft
Damage
Improper use
Weather exposure
Accidental or intentional harm
3.5 Damage, Loss, & Repair Fees
If equipment is returned damaged, non-functional, or missing components, you agree to pay:
Full repair costs or
Full replacement costs if repair is not possible or exceeds value
Cleaning fees for smoke, liquid, or residue exposure
The Company will determine repair or replacement in its sole discretion.
3.6 Unauthorized Modifications
Clients may not alter, open, modify, or attempt repairs on any equipment. Doing so may result in full replacement charges.
3.7 Technical Support
If an issue arises, clients must contact the Company immediately. Failure to do so may limit the ability to assess cause and may result in fees.
3.8 Sub-Rented Gear
If the Company provides sub-rented gear to fulfill a request (e.g., additional microphones or specialty items), you agree to comply with the sub-rental provider’s rules as well.
4. Service Policies
4.1 Scheduling & Booking
Services are reserved on a first-come basis. A booking is considered confirmed only after written approval and any required deposit.
4.2 Customization & Show Needs
Every event is unique. Services are tailored to your event based on:

Budget

Safety considerations
However, customization is not unlimited and remains within the boundaries of available inventory and professional standards.
4.3 On-Site Expectations
Clients must provide:

Safe working environments

Reasonable access to the venue

Adequate power sources
4.4 Event Changes
Last-minute changes to location, schedule, or needs may result in additional charges or reduced service capability.
4.5 Staff Safety
If unsafe conditions arise (weather, crowd behavior, venue hazards), the Company may refuse to continue work without refund.
5. Payment Terms
5.1 Pricing
All pricing is listed on the website or in the provided quote. Prices may change without notice until a booking is confirmed.
5.2 Deposits
A deposit may be required to secure rentals or services. Deposits are generally non-refundable unless otherwise stated.
5.3 Final Payment
Payment is due on or before equipment delivery or the start of services unless otherwise agreed in writing.
5.4 Late Fees
Late returns may incur per-day fees. Long overdue equipment may be treated as lost or stolen and charged accordingly.
6. Cancellations & Refunds
6.1 Client Cancellations
Rentals: Cancellations within 48 hours of the rental start time may incur a fee up to the full rental amount.
Services: Cancellations within 72 hours of the event may incur up to the full service charge.
6.2 Company Cancellations
We may cancel a booking due to:
Equipment failure
Unsafe conditions
Client’s violation of these terms
Circumstances beyond our control
Refunds will be issued for any services not performed unless caused by client violation.
7. Liability
7.1 Limitation of Liability
To the fullest extent allowed by law, the Company is not liable for:
Interrupted events
Loss of revenue
Delays due to weather, venues, or third parties
Client misuse of equipment
Data loss
Any indirect, incidental, or consequential damages
7.2 Maximum Liability
If liability is ever established, it is limited to the total amount the client paid for the specific rental or service.
7.3 Client Indemnification
Clients agree to indemnify and hold harmless the Company against all claims, damages, and expenses arising from:
Misuse of equipment
Unsafe venue conditions
Guest or third-party behavior
Violations of these Terms
8. Privacy & Data
We collect only essential information to process rentals, provide services, and communicate with clients.
Your data is never sold or shared except when necessary to complete your booking or if required by law.
9. Intellectual Property
All website content—text, media, branding, design—is the property of the Company.
You may not reproduce or misuse content without written permission.
10. Amendments
The Company may update these Terms & Conditions at any time. Updates will be posted to the website with a new “Last Updated” date.
Continued use of the website or services means you accept the updated terms.
11. Governing Law
These Terms are governed by the laws of the State of Nebraska, without regard to conflict-of-law principles.
